Butterball, LLC Privacy Policy
Policy
This Privacy Policy is specific to Butterball, LLC, (“Butterball” or “We”) located in the United States. As part of our Terms and Conditions of Use, this Privacy Policy governs your visit to this website and any other website owned and operated by Butterball (the “Sites”). This Privacy Policy sets forth how we collect, store, and use the personal information you provide through each of our Sites. “Personal Information” is data that can be used to uniquely identify or contact a single person. Read this Privacy Policy before you submit any Personal Information to us on our Sites. Also review our Privacy Policy from time to time as we may update or change this Privacy Policy at any time for any reason without notice to you. By using this Site, you indicate your assent to all of the terms of this Privacy Policy and the Terms and Conditions of Use. If you do not agree with any term of this Privacy Policy or the Terms and Conditions of Use, do not use this Site or submit any Personal Information.
Personal Information We Collect and Why
Generally, you may browse the Sites without providing any Personal Information. However, we may ask you to provide Personal Information at various times and places on the Sites. When you visit and use the Sites, we may need to collect certain Personal Information from you in order to provide and improve upon our products, our inventory and services. We do not ask you to provide any Personal Information to simply browse our Sites. If you wish, however, to participate in some of the features and services the Sites may offer, we may ask you to provide certain Personal Information and/or non-personally identifiable or demographic related information. Such Personal Information may include, but is not limited to, your name, home and/or business address, phone number, email address, date of birth, social security number, driver’s license information, payment and credit card information, as well as other non-personally identifiable information or demographic information such as your age, gender, habits, or preferences. When such non-personally identifiable information is tied to you personally (i.e. with other personally identifiable information), it will be treated as Personal Information. We do not collect Personal Information unless you voluntarily provide it to us.
How we collect information from you will depend on how you choose to use our services and interact with us, including the services and opportunities we might provide on the Sites. For example, we may require your name and e-mail address to add you to an e-mail newsletter list and send you recipes or information about company promotions. We may collect Personal Information you provide while using the Sites, such as information you provide during an online transaction (including your credit card or account information, the type of services or products ordered or purchased, shipping and billing addresses, and the date of the order or purchase), any online account information, e-mail addresses, and other information you might provide to us. In the case of placing an order, this information is essential for verification and shipping purposes, and we may also need to contact you about your order. We will store your shipping and billing information if you create an account with us, but this information will not be used by anyone but Butterball and vendors who provide services related to the Sites. Users who register to receive information via a wireless device may be asked to submit a cell phone number to receive text messages. We may also offer the option to interact with one of our representatives directly while using the Sites in order to ask questions, request information, and to assist you in making a purchase or using our services.
You can access many features on the Sites without providing Personal Information to us, but doing so may prevent you from making full use of all the online features and/or promotions we offer and may limit our ability to provide you with the level of service that you would otherwise expect from us, and that we desire to provide.
Cookies and Other Software
We may use cookies or other visit recognition software to improve the use and functionality of our Sites. A cookie is a small data file sent to your browser from a Web server to be stored on your hard drive that may allow easier access the next time the same page is visited. The Sites may use cookies to store information from forms you fill out to create a user profile so that you do not have to re-enter the information each time you visit. If you do not accept our use of cookies on the Sites, it is possible for you to configure your browser to reject cookies by modifying your browser settings. You will note, however, that, if your browser settings do not accept cookies from us, then we cannot guarantee that all functions of the Sites will operate as intended, and you will not be able to make purchases from the Sites.
We may use software or monitoring services which enable us to count aggregate visitors to our sites and which provide us with certain information about visitors such as IP addresses and publicly available information, for the purposes of giving us operational and marketing data about our website visitors’ use of the Sites for our business purposes. The type of information gathered in monitoring use of the Sites could include, but will not be limited to, Internet browser information, operating system information, dates and times of a particular user’s visit and/or click path taken through the site, lookup information, and information that may be publicly available in connection with an IP address such as general location of the user. This aggregate information provides statistics and publicly available information that we use to analyze, market and improve our Sites and business.
How We Use Personal Information
We may use Personal Information to communicate directly with visitors and users, such as to respond to inquiries, complete purchase transactions, to inform users and visitors when they have won a contest, to send you offerings by mail or email, or to fulfill a request for an online newsletter or other online subscription service, to keep you informed about the status of your orders, to notify you of a recall, to provide other information concerning products you have purchased, or to offer additional information about other products, programs, services, promotions or offers that may be of interest. We may also use Personal Information to identify your product and service preferences, to improve our product selections, customer service and overall user experience on our Sites, to analyze shopping and purchasing data or to have a third-party vendor engage in analysis on our behalf, and to research, develop, manage and improve our Sites. We may also transfer Personal Information to our vendors and third-party services providers who provide certain services on Butterball’s and Butterball’s affiliates’ behalf.
We do not rent, sell, or share Personal Information with third parties for any purpose unassociated with the business of Butterball or Butterball’s affiliates unless we have notified you that we intend to do so and have provided you with an opportunity to opt in by giving us permission to do so, although we reserve the right to disclose any Personal Information requested by law enforcement agencies or if we are required to do so by law, regulation, subpoena, court order, or by a government entity.
We also reserve the right to transfer any information, including Personal Information, in the event all, or a portion, of the business or assets of Butterball are sold or transferred, including in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation of our business. In that event, we will use reasonable efforts to require that the transferee use this Personal information in a manner consistent with this Privacy Policy.
What We Share With Others
We limit access to your Personal Information to those within Butterball or its affiliates with a business need to know. We may use or disclose your Personal information to affiliates and third-party partners in certain joint promotional and marketing programs, to manage databases of customer information, to assist us in distributing emails, protect the security and integrity of Sites, to correct technical problems and malfunctions on Sites, to technically process your information, for fraud prevention, or to take precautions against liability. We may disclose information to outside companies that help us bring you the products and services we offer, to your company or organization if you use our services under a corporate or other commercial account, and in connection with any services or products you purchase from us, to your credit card issuer, credit reporting and fraud checking agencies. We also may disclose your Personal Information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating the Terms and Conditions of Use of Sites.

Send Us A Message Using our Easy Online Form
If you choose to write to us, please include your name, address and any contact information that you want removed from our promotional contacts list, including phone numbers, and e-mail addresses, and state one of the following:
- “NO MAIL OFFERS” (if you don’t want to receive offers by mail);
- “NO PHONE OFFERS” (if you don’t want to receive offers by phone); or
- “NO PHONE OR MAIL OFFERS” (if you don’t want to receive either).
If you’ve signed up for mobile messaging (e.g., SMS and MMS) offers but later decide you no longer wish to receive them, simply follow the opt-out instructions included in the mobile message.
If you use more than one e-mail address, send your opt-out e-mail from each of your e-mail addresses. If you receive any online newsletter or similar promotional e-mail communication from us, you will always be given the option to “unsubscribe” from receiving further e-mail communications from us at any time. Your option not to receive promotional and marketing material will not preclude us from corresponding with you, by e-mail or otherwise, regarding your existing or past business relationships with us (e.g., any purchase of our products or use of our services, or responses to requests for information you pose to us either through use of the Sites or by other means), and will not preclude us from accessing and viewing your Personal Information in the course of maintaining and improving the Sites, our products or our services.
Because customer lists generally are prepared well in advance of a communication, eblast or offer, you may continue to receive some offers after you send us a request not to use your information for specified marketing purposes. We appreciate your patience and understanding in giving us time to implement your request.
Third-Party Sites
This Website may link you to other sites on the Internet which are not under the control of Butterball or its affiliates, including several sites operating under license and displaying the Butterball® brand. You acknowledge that Butterball is not responsible for the accuracy, copyright compliance, legality, decency, data collection, privacy policies, or any other aspect of the content of sites it does not operate or control. Your accessing the links to any other sites is at your own risk and subject to the applicable privacy policies and terms and conditions of such websites.
Children’s Online Privacy
The Sites are not intended for children under the age of 18. Butterball does not knowingly solicit or collect Personal Information from children under 18. If you are under the age of 18, please do not submit your e-mail address or any other personal information to us through the Sites. Parents are encouraged to regularly monitor and supervise their children’s on-line activities.
Transfer of Data To the United States
The Sites primarily target users residing in the United States and are governed by and operated in accordance with the laws of the United States. We make no representation that the Sites are operated in accordance with the laws or regulations of, or governed by, any other nation. By accessing and using the Sites, you certify that you meet the age and other eligibility requirements for each Site as set forth in our Terms and Conditions of Use. If you are located outside of the United States, please be advised that any information you provide to us will be transferred to the United States and that by submitting information, including information submitted to us at butterballcorp.com, you explicitly authorize its transfer. Children under the age of majority in any jurisdiction outside of the United States should not provide Personal Information without their parent’s consent.
Business in Europe and Switzerland
Butterball does not intend to conduct business via the Sites with users located in the European Economic Area and Switzerland (the “European Area”), and does not knowingly solicit or accept Personal Information transferred from the European Area for any purposes. If you are located in the European Area, do not submit any Personal Information to the Sites. Butterball expressly disclaims any liability in connection with any such transfer of Personal Information from the European Area. If you are a user in the European Area and would like additional information on doing business with Butterball, please click here for the appropriate points of contact.
International Licensees
Certain licensees also conduct business with users outside of the United States relating to Butterball® products, under license from Butterball. Such third-party licensees are not owned or controlled by Butterball. They may host and administer branded websites for use by customers outside of the United States (“International Sites”). The collection of Personal Information by licensees via any of their respective International Sites or otherwise is administered by the applicable licensee and not by Butterball, and is subject to the privacy policy established by the particular licensee. Users visiting any International Site should consult the International Site for details regarding the applicable privacy policy.
Security
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place physical, electronic, and managerial procedures to safeguard and secure the information we collect online. We take reasonable physical, electronic and administrative steps to maintain the security and accuracy of personally identifiable information we collect, including limiting the number of people who have physical access to our database servers, as well as employing electronic security systems and password protections that guard against unauthorized access. As effective as these measures are, no security procedures or systems are impenetrable. We cannot, and do not, guarantee that any information you supply will not be intercepted during the process of transmitting it to us over the Internet.
For your protection, all orders and payment information provided on the Sites and online credit card transactions are transmitted through a secure server using Secure Socket Layering (SSL), encryption technology. SSL encrypts ordering information such as your name, billing and shipping addresses and credit card number. To be sure that your order is secure, check your web browser during your ordering process. Most browsers use a symbol to indicate that you are on a secured web site. For example, Internet Explorer uses an icon in the bottom, left-hand corner of your browser to communicate to you that a site is secured. Another indicator that you are in a portion of the Sites employing SSL for security purposes is when the letters “http” in the URL change to “https”. The “s” indicates you are in a secure area of the Site. Macintosh® computer users are advised to place their online orders using either Safari® or Mozilla Firefox® web browsers, because either of these browsers allow us to offer our customers the highest level of security. Other browser products may prevent Macintosh computer users from viewing secure pages during the checkout process. Please note that e-mail is not encrypted and is not considered to be a secure means of sharing Personal Information with us, including transmitting credit card or other payment information.
Only authorized Butterball representatives and agents working on Butterball’s behalf have access to transaction data submitted to us via the Sites. Butterball’s representatives and agents will not share Personal Information with any third parties outside of Butterball, other than as set forth in this Privacy Policy. If at any time you provide a third party’s Personal Information to us, whether in the form of a name, shipping address, photo, email address or other, you warrant that you have the permission of the person whose information you submit to share that information with us and you agree to indemnify, defend and hold harmless Butterball and its affiliates and third-party service providers from and against any claim, liability, cost and expense arising in connection with your sending or providing that information to us.
For purposes of forums, discussion boards, certain promotions, and other public interactive areas that may be available on the Sites from time to time, you are solely responsible for the information you post or upload to our Sites. You understand that personal and other information that you post on, or through, publicly accessible areas of our Site are generally accessible to, and may be collected and used by, others and may result in unsolicited messages or other contact from others. We encourage all users of our Sites to be cautious in terms of the nature of the information you post about yourself in any public areas of our Sites.
Updates
We reserve the right to make changes to our Privacy Policy from time to time for any reason. Such changes, modifications, additions, or deletions shall be effective immediately upon posting unless otherwise indicated. We have no duty or obligation to inform prior visitors that changes have been made, regardless of the scope and importance of the changes. Check back and review this policy so that you always know what information we collect, how we use it, and to whom we disclose it. Your continued use of this Web site after changes are posted will be deemed to constitute your agreement to and acceptance of such changes.
